There are two main types of sobriety tests you can be given – field
and lab. Field sobriety tests are given on the spot when you are pulled
over. There are a number of tests that all officers, no matter where
they live, are taught. These include the following:
- Horizontal Gaze Nystagmus Test
You are under no obligation to take any of these tests. While you do
not have the right to speak to a lawyer at this point, as you haven’t
been arrested or charged with anything, you also do not have to take
any field tests or answer any questions.
That’s not the case with the chemical, or lab, test. If an officer asks
you to take a breath, blood, or urine test, you have the right to
refuse – but doing so, whether you are drunk or not, will automatically
cause your license to be suspended for 90 days.
Once again, drinking and driving isn’t just illegal – it is very
dangerous. If you’re worried about you judgment, invest in some
personal sobriety test products. That way, before you get behind the
wheel, you can test yourself to ensure that you’re under the legal
limit. These products can be purchased from medical supply companies
for about $500. Cheaper (albeit, less accurate) products are also
available. Typically, though, if there is any question in your mind
about your BAC, you should not get behind the wheel. Drunk driving is
no joke.
